The studio

Painted (painted.app) is operated by PaintedApp, LLC. Using the studio means agreeing to these terms. If you do not agree, do not use it. You must be 18 or over to hold an account or to buy anything.

How a painting is made

A line, a photograph or a drawing goes with our own instruction for the hand you chose to three image models from OpenAI (gpt-image-1, gpt-image-1-mini and gpt-image-1.5), which return three frames. The hands are described by us after painters who have been gone seventy years or more; no living artist is named or imitated, and a line that names one is refused. We may refuse to paint anything, and our moderation refuses content we will not make.

What is free

One painting a day for a visitor without an account, watermarked, shown on this browser’s wall for a day. Accounts hold a daily limit as well. Free paintings are for looking at, not for reproducing or distributing.

What you own, and what you may do with it

You keep every right in the line, photograph or drawing you bring. You grant us a licence to store it and to send it to the providers named in the privacy page for the sole purpose of painting from it and fulfilling your order. You promise the photograph is yours to use and, where a child appears, that you are the child’s parent or guardian.

A painting you have paid for, or that a plan has granted, is licensed to you for personal use: keep it, print it anywhere at any size, hang it, wear it, give it. You may not resell it, license it, use it in advertising, sell it as stock or use it to train a model. A watermarked preview is for evaluation only.

Museum scans

Scans on the shelf are public domain or CC0, held by the museums named on their plaques, and the licence stated there applies to the scan. As a seed, a scan lends a painting its handling, never its subject, and the credit stays on the plaque and the share page. A print of a scan is the scan as the museum released it; it is never upscaled and only sizes its pixels carry at 150 pixels an inch are offered.

Hanging, approval and orders

Nothing can be bought until you have hung a frame and approved its exposure. The frame you hung, at the exposure you approved, is the file that is delivered and printed. If you change the exposure after hanging, the painting must be hung again before it can be bought. Prints, canvases and garments are made to order by Prodigi and Printful and are not returnable except for a fault in making or delivery, which we put right or refund. Prices are in US dollars, set on the order page before you pay, and charged by Stripe. The server prices every order itself; a price shown anywhere else does not bind us.

Gifts

An order sent to someone else goes to the address you give with the note you write. You are responsible for having their consent to receive it and for the note’s contents.

Plans

The plans are Sitter ($12 a month, 15 paintings), Collector ($29 a month, 50 paintings), Patron ($79 a month, 200 paintings), billed monthly by Stripe until cancelled. A painting is one line, photograph or drawing painted, whichever frame you hang; a painting that fails before any frame finishes is credited back. Unused paintings roll over. Cancel any time from Manage; the paid month runs to its end, the balance granted stays, and nothing already painted is taken back. A Patron palette sampled from your own painting stays yours after the plan ends.

Share pages

A share page shows only the painting, its title, its plaque and a door to the studio, to anyone with its link. You turn it on and off. Turning it off removes our page and image; copies others took while it was on are outside our reach. No painting that contains a child is given one.

Your wall

Only you can see your workroom and your wall and buy what is on them. A share is the only thing of yours anyone else sees, and only when you chose it.

Limits

The studio is offered as it is. We do not promise a particular painting, a likeness, or that the studio is available at every moment. Our liability to you is limited to what you paid us in the twelve months before the claim, except where the law does not allow that limit. These terms are governed by the laws of Oregon, USA.

Changes

When these terms change, the date at the top changes with it, and a material change is announced on the wall before it takes effect.
